Established in 2003, Integrated Domestic Violence (IDV) Courts are designed for a single judge to preside over multiple cases between family members, where the underlying issue is alleged domestic violence.
For example, a husband and wife may have an open domestic violence case and an open divorce case. The reasoning behind the court is that this will allow cases to be resolved by one court. This causes many problems. Frst, the defendant may have a hard time obtaining a fair divorce settlement because the other party may be using the domestic violence charges against him/her.
Also, if the judge is not happy with one party in the civil case, it may harm that person if that same judge is called upon to decide guilt or innocence. This can be a problem if the defendant cannot afford the same type of attorneys that the other party may be able to.
